Old Bailey Proceedings, 29th June 1743. THE PROCEEDINGS ON THE KING'S Commissions of the PEACE, and Oyer and Terminer, HELD FOR THE CITY of LONDON, AND County of MIDDLESEX, AT JUSTICE-HALL in the Old-Bailey, on WEDNESDAY June 29, THURSDAY June 30, and FRIDAY July 1. In the 17th Year of His MAJESTY'S Reign. BEING THE Sixth SESSIONS in the MAYORALTY OF THE Right Hon. Robert Willimott , Esq; LORD-MAYOR of the CITY of LONDON. NUMBER VI. Margaret Clark . I live with Mrs Wills as her upper Servant; I lost 7 Spoons in the Whole; I missed them on Tuesday was Se'nnight; I have 2 of them, but some were sold; the Prisoner confessed that he took a large Spoon and a Tea-Spoon out of the Pantry, and likewise, that on Tuesday last he took another large Spoon with a Coat of Arms, and a Salt-Spoon out of the Kitchen, and he owned the taking a large Silver Spoon about 3 Weeks before - He owned the stealing this large Silver Spoon on Tuesday last: Mrs Wills took him into the House, and clothed him till she could get a Place for him to go to Sea. Isaac Callow . I am a Silversmith; the Prisoner came with this Bit of a broken Spoon, as I was standing at my Door in the Evening, with a very plausible Story, and said he had found it in Tottenham-Court Road, and did not know whether it was Silver, and desired to be inform'd; it being battered so, I could not readily tell which, I told him it was Silver; he asked me whether I would buy it; I asked him whether he had got a Father and Mother, he said that he had, and that they lived in Cary-Court in Drury-Lane; I asked him whether it was not his Father's, he said no; and the Boy that was with him claimed half of it, and said they found it; I could not tell whether it was good or bad Silver; there was an Ounce and a Quarter, and I gave him 5 s. and 6 d. for it. John Thrift . On Wednesday Night the Prisoner came into the Coal Yard, with another Boy who was going to Tothill Fields Bridewell, and the Prisoner said he would give me a Shilling to go with him to get the Bowl of a Spoon which was stopped, and to say I was his Father. I said, if he would stay a Minute, I would get a Person to do it. I took them both by the Collar; got a Constable and secured him. Q. What Business are you? Thrift. I am the Executioner. Q. What! Jack Ketch ? Thrift. Yes. John Hyat . On Wednesday Night I was in the Coal-Yard, and John Thrift catched me with the Prisoner, but the Boy owned nothing to me about the Spoon. Thomas Evans . The Prisoner is my Son; he is 13 Years of Age come November next; he has been from under my Care a great while; I was not able to maintain him; he was brought up next Door to Madam Wills, who has been very kind to him, and I am very sorry he has disobliged her: I will take Care to send him abroad; I have an Acquaintance a Captain of a Ship that will take him. I beg your Lordship will give me Leave to send him abroad. The Prisoner's Mother in Law said, she had been very kind to him, and had often given him Money to keep him out of Temptations, and that she is very sorry he is so unhappy as to be here. Guilty . Lydney is within a few miles of St. Brivals Castle and the Forest of Dean. There are no specific dates given with this chart, however, it contains three generations of the descendants of Thomas Hyett of Lydney and Joyce daughter and co-heir of Simon Melbourne of Icomb in the county of Hereford. As this visitation was made in 1543 and on one is listed as deceased, it can be assumed that all were living at this time. On page 74 of this same volume, we find the following: Christopher Hall of High Meadow, married Joane, daughter of James Hyett of Lydney. The interesting part is that James coat of arms are listed: Argent a lion rampant and a chief indented sable, a very similar arms again to the first family. Continuing down the Severn to its mouth in the Bristol Channel, we come to the county of Sommerset where in an early visitation Philip Hyett of Michelny near Langport is recorded with his family. This is a three generation chart ending with Thomas Codington of Codington (in Wapley) Gloucester. In connection with this chart is a note that the will of a John Hyett of Street was proved in 1559 by Anne his wife. Again, the arms listed for this family are: Argent a lion rampant gules; a chief, per fesse indented, of the first and sable. Reference for this is made to Burkes peerage. In the county of Somerset, there is an arrest records in 1683 for John Hyott of Shipton-Mallet as a religious dissenter. Shipton -Mallet is fairly close to the towns mentioned above, Street and Michelny and probably John Hyott is of these families. Even though the visitation is from a century earlier, it is possible that family migration occurred between Sommerset and Gloucester. At any rate, John Hyott, a religious dissenter, appears only 10 miles from Glastonbury where a William Smith attended Quaker meeting and eventually brought a letter to the Quaker Meeting in Philadelphia according to the records of 1699. This is thought by many to be the William Smith of Cecil County, Maryland who died mentioning his daughter Mary wife of John Huyet in his will. Is there any connection to the John Hyett of Westbury on Severn, Gloucester, and the John Hyott of Shipton-Mallett, Sommerset? Both seem to be good possibilities for John Hyett the Colonial Immigrant but more research into these two areas is needed. SOURCES: 1. Michael H. Charles *REF: 24 2. HYATT, Mr. Ann Street, St Helier, Jersey. A watch and clock maker known to have been working in 1845. A John Hyatt, son of John Hyatt of Preston, Somerset is recorded, apprenticed to James Gould 1733 free 1741, he was in partnership with Charles Semore 1757 and is noted in 1773. Also an Edward Hyatt, watchmaker, is recorded at Newnham, Gloucestershire, in 1839, when his daughter was born, and a Lewis Hyett, watchmaker, worked at Gloucester in 1852-1857 ********************************************************************************* William SMITH Senior was born in 1651 in Glastonbury, Somerset, England. He was christened in 1651 in Shepton-Mallet, Somerset, England. He died on 20 May 1710 at the age of 59 in Cecil County, Maryland. William has Ancestral File Number 5CV6-0F. Larry Anderson wrote in the preface of his book, "HIATT -HIETT - HYATT" :" On page 33 of the Hiatt-Hiett Family History andGenealogy by William Perry Johnson wrote as follows: Some fifty miles southwest of Philadelphia, in the northeast corner of the state of Maryland, lies the county of Cecil. It was here, in Cecil Co., MD, that William Smith wrote his will on the 20th of September 1708; it was proved the 20th of May 1710. He leaves to second son John and heirs, 1000 Acres, dwelling plantation --- to dau. Mary, wife of John Hayet and granddau. Hannah, dau. of son William, personality (i.e., personal property --- editor.) -- Exrs: wife Grace and son John ---- (R32) It is quite significant that the John "Hayet" named in the will becomes John Hiett in further court proceedings regarding the will. From this evidence, both traditional and documentary, it is reasonably certain that the wife of our John Hiett, immigrant, was Mary Smith, daughter of William (R33) For those interested in a further investigation of the Smiths, it is suggested they check the William Smith Quaker, who brought a certificate to Philadelphia, for himself and wife and family. William and John Smith, brothers of Mary (Smith) Hiett, are probably ancestors of the Smiths who settled in Virginia in the same community and at about the same time as did John Hiatt, Jr., and his brother William Hiatt, sons of John and Mary (Smith) Hiett. In the 43 years that have elapsed since The Genealogy was published some additional data has surfaced. William Perry Johnson’s conviction that John Hiett was the son-in-law of William Smith of Cecil County, Maryland might have been even stronger had he seen three of these items. In the will mentioned above, William Smith made bequests to his second son, John, and to Hannah, daughter of his son, William. We now know that son, William Smith, Jr. was already deceased. On 27 Jul.1708, about six weeks before William, Sr., signed his own will, John Hiatt was appointed administrator of the estate of William Smith in common with James Robinson and Samson George. This action suggests that John Hiett must have been living in Cecil County, Maryland by this time and not 60 miles away in Bucks County, Pennsylvania. [Testamentary Proceedings, Cecil County, Maryland, Liber 21,filio 61] The administrators of the estate of William Smith, Sr. in 1710, two years later, were John Smith, Nicholas Hyland, and Samson George." *********************************************************************************
